What is Color or Race Discrimination?

Color or race discrimination occurs when an employee is treated differently based on their skin color, ethnicity, or nationality. Your Rights Under Federal and State Laws

The U.S. Equal Employment Opportunity Commission (EEOC) enforces federal laws that prohibit employment discrimination based on race and color, among other protected categories. These laws include:

  • Section 1981 of the Civil Rights Act of 1866: This law protects against discrimination based on race. There is no requirement that the employee exhaust administrative remedies by filing an EEOC or PHRC charge within 300 days of the adverse action. It protects workers even if their employer does not have a lot of employees, and it also protects independent contractors.

  • Title VII of the Civil Rights Act of 1964: This federal law prohibits discrimination in the workplace based on race, color, religion, sex, and national origin.

  • The Civil Rights Act of 1991: This act amended Title VII to allow victims of intentional discrimination to seek compensatory damages and monetary relief for emotional distress.

In addition to federal laws, the state of Pennsylvania also has its own anti-discrimination laws. The Pennsylvania Human Relations Act (PHRA) prohibits discrimination in employment based on race, color, religion, ancestry, national origin, age, sex, familial status, or disability.
